15 Must-Haves for HIPAA Compliance

Security

5 items

AES-256 Encryption at Rest

All files containing PHI must be encrypted with AES-256 (FIPS 197) when stored on disk. Plaintext copies should never persist after processing.

Encryption Key Management

Encryption keys must be protected by the operating system's credential store (DPAPI on Windows, Keychain on macOS). No plaintext keys stored on disk.

Session Lock and Timeout

The application must lock after a configurable period of inactivity and require PIN or password re-authentication. HIPAA requires automatic logoff (Section 164.312(a)(2)(iii)).

Secure Temporary File Deletion

Temporary files created during processing must be overwritten with random data before deletion. Simple file deletion leaves recoverable data on disk.

No Cloud Transmission of PHI

Document processing must happen locally. If any data leaves the machine, you need a BAA with every cloud provider in the chain, and the data must be encrypted in transit (TLS 1.2+).

OCR Accuracy Validation

Your OCR engine must be validated against ground-truth data. A single misread digit in a medical record number or date of birth can compromise an entire case.

Bates Numbering with Verification

Every page in production must receive a unique sequential identifier. The system should generate a verification log confirming no gaps or duplicates in the numbering sequence.

Automated Chronology Building

Manual chronology creation is error-prone and expensive. Your tool should extract dates, providers, and events automatically and flag gaps in the treatment timeline.

Duplicate Detection

Medical record productions frequently contain duplicate pages. Your system should identify and flag duplicates to prevent paralegals from reviewing the same document twice.

Professional Output Formatting

Excel exports must include proper headers, formatted columns, and print-ready layouts. Output that requires manual formatting wastes paralegal time and introduces errors.

Compliance

Tamper-Evident Audit Trail

Every action taken on records must be logged with timestamps, user identity, and action details. Logs must be tamper-evident and retained for a minimum of 6 years (HIPAA requirement).

PHI Redaction Capability

Before sharing records externally, you must be able to redact all 18 HIPAA identifiers (names, dates, SSNs, MRNs, addresses, etc.) to meet Safe Harbor de-identification standards.

Business Associate Agreement (BAA)

Any vendor that handles PHI on your behalf must sign a BAA. This includes record processing software, cloud storage, and outsourced review services. No BAA = no HIPAA compliance.

Data Retention and Disposal Policy

You must have a documented policy for how long records are retained and how they are destroyed. Encrypted deletion or multi-pass overwrite is required for electronic PHI.

Breach Notification Readiness

Have a documented incident response plan. HIPAA requires notification to affected individuals within 60 days of discovering a breach. Your software should support forensic investigation.
